DUI Elements Explained – Unlawful Blood Alcohol Level (UBAL) DUI

One of the two ways in which a Florida DUI can be committed and proven is by operating a vehicle with an Unlawful Blood Alcohol Level (UBAL). UBAL and impaired driving presumption blood alcohol levels are proven by means of chemical tests of a driver's breath, blood or urine. These tests are required under the Florida DUI and driver's licensing laws and refusing them will result in severe penalties which should not be taken lightly. The results of these tests, especially breath tests, are not exact and in some cases do not reflect the driver's blood alcohol content at the time that they are accused of driving while under the influence.
